Fundraise for Blood Cancer — Participant Terms and Conditions

By registering for Fundraise for Blood Cancer (the Campaign), I agree to the following terms and conditions.

1. Participation and responsibility

I understand that my participation, including any fundraising activity or event I organise, is voluntary and undertaken at my own risk.

I acknowledge that the Leukaemia Foundation of Australia Limited (Leukaemia Foundation) does not organise, supervise or control participant-led activities or events. I am solely responsible for planning and safely conducting my activity, including:

  • assessing and managing risks;
  • appropriately supervising participants and guests;
  • ensuring food, equipment and venues are safe and suitable;
  • obtaining any necessary permits, licences, approvals and insurance; and
  • complying with applicable laws and health and safety requirements.

I understand that I am not an employee, agent or volunteer of the Leukaemia Foundation and must not represent that my activity is organised by the Leukaemia Foundation.

2. Risks

I understand that participation may involve risks, including bodily or psychological injury, illness, allergic reactions, foodborne illness, burns, cuts, equipment failure, property damage, changing weather conditions, environmental hazards and accidents requiring medical or emergency assistance that may not be readily available.

I freely accept all risks associated with my participation and any activity I organise, including risks that may not be reasonably foreseeable.

3. Release, waiver and indemnity

To the fullest extent permitted by law, I:

  • release and discharge the Leukaemia Foundation, its officers, employees, volunteers, contractors and Campaign sponsors from all liabilities, claims, demands, damages, losses, costs, expenses, injuries, death or inconvenience arising from or connected with my participation or any activity I organise; and
  • indemnify and hold harmless those parties against any claim, liability, loss, damage, cost or expense arising from my acts or omissions, my breach of these terms, or any activity I organise.

This release and indemnity applies regardless of how the loss, damage or injury occurs, including through negligence, breach of contract or breach of statutory or other duty, except to the extent that liability cannot lawfully be excluded or limited.

4. Fundraising authority and compliance

I agree that all fundraising undertaken for the Campaign will comply with:

  • the Leukaemia Foundation’s Community Fundraising Guidelines;
  • all applicable federal, state, territory and local laws;
  • relevant food safety, responsible service of alcohol, gaming, raffle, health and safety requirements; and
  • any directions provided by the Leukaemia Foundation.

My registration authorises me to receive donations through the personal fundraising page provided. I must obtain written Authority to Fundraise from the Leukaemia Foundation before conducting any additional fundraising activity or event.

I understand that the Leukaemia Foundation’s insurance does not cover my activity. I am responsible for determining and obtaining any insurance required.

The Leukaemia Foundation may refuse, suspend or withdraw my authority to fundraise, remove content or close my fundraising page if it reasonably considers that my conduct or activity:

  • creates an unacceptable safety, legal, financial or reputational risk;
  • does not comply with these terms or the Community Fundraising Guidelines; or
  • could harm the Leukaemia Foundation, its reputation or the communities it supports.

5. Age requirements

I confirm that I am at least 18 years old.

If I am under 18, I confirm that my parent or legal guardian has reviewed and accepted these terms and has given permission for me to participate. My parent or guardian is responsible for supervising my participation and any fundraising activity I undertake.

6. Images and content

I give the Leukaemia Foundation permission to use my name, image and voice where captured in connection with the Campaign by, or on behalf of, the Leukaemia Foundation. This permission is royalty-free and allows use in Leukaemia Foundation communications, websites, social media, advertising, marketing and promotional materials.

Where the Leukaemia Foundation asks to use content I have created or posted, my approval of that request grants the Leukaemia Foundation a non-exclusive, royalty-free right to reproduce, edit, publish, share and communicate that content through its owned and paid channels.

For any content I provide or approve for use, I confirm that:

  • I own the content or have permission to grant these rights;
  • the content does not infringe another person’s intellectual property, privacy, publicity or other legal rights;
  • I have obtained consent from every identifiable person appearing in the content, including parent or guardian consent for anyone under 18; and
  • the content is lawful and is not misleading, discriminatory, defamatory, offensive or harmful.

The Leukaemia Foundation may refuse to use or may remove content at any time.

7. Personal information and communications

The Leukaemia Foundation will collect, use and disclose my personal information to administer and support my participation and fundraising, communicate with me about the Campaign, maintain its records, and for other purposes described in its Privacy Policy or permitted by law.

Campaign-related communications may be sent by email, SMS, telephone, social media or other appropriate channels.

Where I have provided any separate marketing consent, the Leukaemia Foundation may also contact me about other campaigns, fundraising opportunities, services and activities. I can change my communication preferences or unsubscribe from marketing communications at any time by contacting the Leukaemia Foundation on 1800 500 088 or at supporters@leukaemia.org.au.
